Anti - Harassment Policy at Jaaga

​

  • While Jaaga urges its co-workers and community members to connect, communicate and collaborate to enhance their success and ensure sustainability, it also identifies the requirement of a harassment-free environment. Jaaga believes in an environment where independent professionals, within its premises, including its co-workers and community members feel safe, secure and respected.

​

  • It is mandatory for all Users inclduing all of Jaaga’s co-workers, community members, guests, visitors, start-ups/companies/entities(which includes their employees, interns and staff, assignees, agents, and all persons through or under them), visitors (including organisers, attendees and speakers at workshops held at or by Jaaga) and any other person/s within its premises or associsted thereof, to strictly adhere to and abide by its ethics policy as well as this Anti-Harassment Policy.

  • By signing up with Jaaga, visiting Our website/space and/or using any of our services (online or offline), you agree to be bound by this.

​

  • Please note that you are not employed with Jaaga and by opting to come to Jaaga, you recognise that you are not our employee.

​

  • If you are a Company/LLP/ entity with employees, you hereby understand and undertake to comply with all the mandates of the Protection of Women against Sexual Harassment Act. You also undertake to carry out a training to educate all your employees against sexual harassment.

​

  • Jaaga has a strict No-Harassment policy regardless of gender, race, religion, sexual orientation, disability, physical appearance, body shape, body size, social or economic status or in any other form or manner.

​

  • You understand that if You are found in violation of any of these rules, You may removed with immediate effect from the community and space and your membership shall stands cancelled with immediate effect. responded

​

  • Though this list is not exhaustive, “Harassment”, whether explicit or implicit, means and includes:

    • Non-consensual or unwelcome sexual attention, sexual comments, sexual advances, sexual behaviour, sexual gestures, requests or demands for sexual favours

    • Any unwelcome behaviour with sexual undertones which has been directed against a person either directly or indirectly.

    • Sexual images in public spaces

    • Inappropriate gratuitous or off-topic sexual images or behaviour within the co-working premises

    • Any form of verbal, non-verbal, or physical conduct tainted with sexuality including sexually coloured remarks, jokes, letters, phone calls, e-mail, sms, gestures, showing pornography, lurid stares, sounds, signs etc., which offends the individual’s sensibilities

    • Molestation, Stares, eve-teasing, innuendos, taunts

    • Stalking, and/or following (online or offline)

    • Non-consensual or unwelcome physical contact, prolonged physical contact even after a request to stop or non-consensual, unwelcome or inappropriate social contact

    • Any other form of sexual harassment

    • Offensive comments and/or use of abusive language and/or disrespectful language (online or offline) made directly or indirectly, aimed at individual/s/ entities with the intention of offending, intimidating or harassing them

    • Non-consensual or unwelcome virtual or simulated contact like texting, logging, tracking online activity etc.

    • Photography or audio/ video recording without consent

    • Deliberate intimidation

    • Physical confinement and intrusion into a person’s privacy against their will

    • Comments targeted towards or against or related to gender, identity and expression, ethnic origin, religious and/or political convictions, sexual orientation, disability, mental ailments and illness, physical appearance, body size, body shape, age, race, caste or religion

    • Unwelcome comments regarding a person’s lifestyle choices and practices, including those related to food, health, parenting, drugs, and employment.

    • Threats and/or incitement of violence or violence towards any individual, including encouraging a person to commit suicide or to engage in self-harm

    • Continued attempts at communication after requests to cease

    • Sustained disruption of work, meetings, get-togethers, talks, workshops, discussions or other events

    • Sharing personal and/or professional information/data, communications, details about their professional and/or personal life without consent with an intention to cause personal or professional harm and abuse.

    • Advocating for, or encouraging, any of the above behavior

  • While this Policy primarily applies to acts within the premises, but if you do face an uncomfortable situation outside of our community by a member. People asked to stop any harassing behaviour are expected to comply immediately. Any report of behaviour or action experienced as harassment will be taken in good-faith and responded to as such.

​

  • However, it is made clear that Jaaga will not entertain any form of complaints made against reasonable forms of communications, criticisms, ‘subjective’ rude behaviour, individual problems with tone and tenor of fellow members, visitors, etc., including expression of criticism or disapproval of racist, sexist, classist or any other form of oppressive presumptions, statements or behaviour.

  • You may choose to report harassment anonymously, or you can choose to include your contact information, but we strongly recommend that you disclose Your name/ name of the victim to at least to one of our board/steering committee members. Jaaga shall to its best ability work towards safeguarding the victim and we will honour Your request for anonymity, if the request is reasonable in our opinion.

​

  • Jaaga respects Your privacy and shall, to its best ability maintain confidentiality of the identity of the victim and the alleged abuser.. However, at our sole discretion, Jaaga may decide to name the abuser to other community members or reach out to certain other third parties and police authorities to ensure safety of its members as well as the general public.

​

  • All reports will be handled by an independent co-worker, community member or an outsider, as may be decided by Jaaga’s board members/ Steering Committee and adjudication will be based on the principles of natural justice. If the person is accused or is complaining against any of the acts above is on the board/Steering Committee, such person will not be included in or take part in any of the decision-making processes and will recuse themselves.

  • You hereby agree that You will not publish anything on any public and/or social platform, approach the media or spread any information for reporting harassment or in any form or manner malign or abuse Jaaga in any manner either publicly or in private.

​

  • We will respond within 3 days of your report, and sooner if at all possible. We reserve the right to reject any report we believe to have been made in bad faith.

​

  • Jaaga shall take the necessary measures to prevent the harassment practices recur.
